BOARD OF APPEALS

REGULAR MEETING AND PUBLIC HEARING

SEPTEMBER 15, 2008

1. Meeting called to order at 7:15 PM by chair Greene.

2. Roll call: Members present: Robson, Cox, Greene and Joyce. Absent: French

Also present: Mr. & Mrs. Juif, Tom Ritter & Fred Atchison

3. Chair explains the formation, powers and duties of the ZBA and the public hearing procedure to be followed. Four members were present. Chair explained that a majority of three votes is needed to take action. With four members present, a tie vote would be defeated. Variances are granted to the property, not to the owner. Petitioner may request a full board and the case will be tabled until a full board is present. Chair reads 125.3606 MCL concerning appeal. An appeal under this section shall be filed within 30 days after the zoning board of appeals certifies its decision in writing or approves the minutes of its decision. Appeals of zoning decisions are made in circuit court.

Chair asks petitioner if he requests a full board? No (Mr. Ritter)

Chair reads section 23.04.C Motion by Joyce support by Robson that all four conditions have been met. Four ayes, one absent. Motion carried.

Motion by Cox support by Robson special condition 23.04.2C has been met. Four ayes, one absent. Motion carried.

Review Administrative Standards Sec. 21.01 (A thru O)

Motion by Joyce support by Robson Administrative Standards in place. Four ayes, one absent. Motion carried.

Chair opens public hearing on #08-04 at 7:30 PM.

1. Consideration for erosion & drainage thru vegetative barrier-trees min. of 3 8-ft tall blue spruce between porch and property line to block view from porch to neighbors & vice versa. (east side)

French – absent, Joyce – aye, Greene – aye, Cox – aye and Robson – aye. Four ayes. Motion carried.
