GRAYLING TOWNSHIP ZONING BOARD OF APPEALS REGULAR MEETING & PUBLIC HEARING APRIL 17, 2006

I. Meeting called to order at 7:00 p.m. by chairperson Greene.

II. Members present: Greene, Robson, Jansen, Joyce & French.

Members absent: None

Others: Various other guests present. Recording secretary: Terry Wright

III. Motion by Jansen support by Robson to approve minutes from March 20, 2006. All ayes. Motion carried.

IV. Citizens who wish to speak: John Mc Donell – Requests notification be sent by certified mail.

V. Chair explains duties of the ZBA and the public hearing procedure to be followed. Full board present. Chair explains that a quorum of threee member is necessary to take action, Variances are granted to the property, not to the owner. Appeals of zoning decisions are made in circuit court. The process to start an appeal takes 60- 90 days.Chair reads 23.04.C (Basic & Special Conditions) into record. Motion by Joyce support by Jansen that 23.04.1 A-D have been met. All ayes. Motion carried. Chair reads 21.01 (Administrative Standards) into record.

Motion by Jansen support by Robson that standards are in place. All ayes. Motion carried. No conflicts by board.

VI. Chair opens public hearing. Chair reads request;

Request: To construct a new residence with attached garage. The closest point of construction to the south property line would be 4.5-feet to a non-buildable,8-foot wide easement (1st variance is a 5.5-foot setback), and to within 22-feet of rear property line (2nd variance is an 18-foot rear setback). Existing home and garage will be removed.

Bill Weaver (AuSable Construction) & Darlene Knight explain request for a 40 X 50 house and a 24 X 36 garage.

Speakers in favor – Jim Clements – No problem.

Speaker in opposition – Dennis Platte- Reads letter- neighbor behind. Owns 8-foot easement to lake- view will be altered. Objects to variance which will alter view. There is room to build narrower home without altering our view. Variance will effect property values. Variance is contrary to public interest (conservation of property values). No practical difficulties to meeting the setback requirements. We request side setback denial.

Correspondence in opposition – Charles & Wendy Karpinski- Both side setbacks should be met. Strong rejection to approval of side setback. Uphold ordinance.

Board discusses petition with Mrs. Knight and Bill Weaver.

Motion by Robson support by Jansen to approve as requested. All ayes. Motion carried.

The garage will be within 95-feet of the mainstream of the AuSable River (3rd variance is 105-foot front setback) and within 10-feet of the existing home wit firewall (4th variance is 5-foot distance from residence).
