GRAYLING TOWNSHIP ZONING BOARD OF APPEALS REGULAR MEETING & PUBLIC HEARING

MONDAY, NOVEMBER 21,2005

I. Meeting called to order at 7:00 p.m. by chairperson Greene

II. Roll call: Members present: Jansen, Robson, Greene, French & Joyce

Members Absent: None Recording Secretary: Terry Wright

Others Present: Larry Ostrowski, John & Connie Novak, Monte Burmeister, Bill Greene & Brian Burry (DNR)

III. Chair explains the formation, powers and duties of the ZBA and the public hearing procedure to be followed. Full board was present Chair explained that a quorum of three members is necessary to take action. A tie vote would be defeated. Variances are granted to the property, not to the owner. Appeals of zoning board decisions are made in circuit court. The process to start an appeal takes 60-90 days. Sec. 23.04.C read into record.

Motion by Joyce, support by Jansen that Sec. 23.04.C has been met. All Ayes. Motion carried. Sec. 23.04.2C Special conditions read into record.

Motion by Jansen, support by French Sec. 23.04.2C Special conditions were stated for the record. All Ayes. Motion carried.

Chair reads 21.01 administrative standards.

Motion by Robson, support by Joyce that standards have been met. All Ayes. Motion carried.

IV. PUBLIC HEARING Case #OS-013

Gerry & Dot Brezeznski 14639 Eagles Lookout Ct. Ft. Meyers, FL 33912

040-45-761-02-001-00 Location: Corner of Battalion & Crawford Ave. T26N, R4W, Sec. 9 Lot Size: 150-feet wide X 125-feet deep (18,750 sq. ft.) General Residential (R-2)

Request: Variance of 20-feet in the required rear yard to allow a new home to be built within 20-feet of the property line. Owners represented by William Raymond of B & B Construction

No correspondence for or against.

Chair closed public hearing at 7:19 P.M.

Robson: Ordinance states rear is always the shortest lot line. No variance needed. Discussion on front vs. rear of lots.

Motion by Robson, support by Jansen this case does not require a variance.

Roll call vote: Jansen, Yes; Robson, Yes; Greene, No; Joyce, Yes; French, Yes. Motion carried.

V. Case #OS-014 John & Connie Novak 227 Elbow Trail Grayling, MI 49738

040-41-012-04-100-01 Location: Same T26N, R3 W, Sec. 11 Lot size: 113-feet wide X 700-feet deep (79,100 sq.ft.) Natural River District(NRD)

Request: To build a deck with a variance of 30-feet on required side yard and a variance of 138-feet on the required front yard setback, with a 6-foot wide, wooden sidewalk leading from deck to conforming dock.

No correspondence in favor.

Opposition: Chair reads letter from Brian Burry (DNR), Scale of project could be reduced, to reduce non-conformity. Copy of letter on file.

Board discusses with owners that Mr.Novak is handicapped.

Motion by Jansen, support by Robson Sec. 23.04.2B applies to this case.

All Ayes. Motion carried.

Chair closes public hearing at 7:45 P.M. Discussion by board with owners. Motion by Robson, support by Jansen to approve as presented.

Roll call vote: French, Yes; Joyce, No; Greene, No; Jansen, No; Robson, Yes. Motion denied. Reasons: French- 23.04 2 A & B Joyce- 16.OS.D.2 Greene- 16.07, 16.05.13 & 16.02.B Jansen- 16.05.2 Robson- 23.04.C2 A & B

Motion by Jansen, support by Robson to approve side variance of 30-feet, a front variance of 132-feet and a wooden sidewalk not to exceed 168 sq. ft. from deck to conforming dock.

Brian Burry (DNR) agrees to amendment.

Roll call vote: Robson, Yes; Jansen, Yes; Greene, Yes; Joyce, Yes; French, Yes. Motion approved.

VI. Minutes

Motion by Jansen support by Robson to approve 10-17-OS minutes as presented. All Ayes. Motion carried.

VII. Ask Planning commission to review corner & rear yard definitions & sketches motion by Jansen support by Robson. All Ayes.

Motion carried.

Discussions of other general items. Monte Burmeister discusses methods of recording reasons for approvals and disapproval.. Chair asks for a new form for each member to document the following at each meeting; (1) Discussion

(2) Decisions (3) Reasons why Monte Burmeister recommends the township not issue building permits until the 60 day appeal time has expired after the variance is granted.
