GRAYLING TOWNSHIP PLANNING COMMISSION MINUTES

JULY 31, 2007

1. The meeting was called to order by chairperson Jansen at 7:00 p.m.

2. Pledge of Allegiance.

3. Roll Call: Long, DiPonio, Jansen, Cox & Hood. All present.

Guests: See attached list.

4. Motion by DiPonio support by Long to approve minutes of May 29, 2007. All in favor. Motion carried.

Supervisor Wright announced Grayling Township is now a Charter Township as of July 11, 2007. There will be some procedural changes that he will address at a future meeting.

5. Case #07-01PUD Planned Unit Development

Petitioner: Axiom Entertainment

Addresss: 222 South Main Street Rochester Hills, MI 48307

Location: All state-owned property in T26N, RW, Sec. 20,29,32,33

Parcel size: Approx. 1,800 acres

Zoning: Planned Industrial & Planned Commercial

Request: Request to re-zone entire area into a Planned Unit Development with various uses.

Chairman Jansen reads a letter received from Vincent Lajiness (copy on file), then opened the Public hearing.

A variety of concerns were expressed regarding individuals ingress and egress, property values, other entertainment venues like Auto World and Cereal City that failed, impact on the aquifer, the AuSable River, local landfill capacity, nightly fireworks, light and sound pollution, 4 Mile Road traffic impact and county bond process.

Pat Crosson from Axiom Entertainment explained that many of these issues are to be addressed at a later date as the permitting process procedes. He added that the Park rides will shut down at 10:30 p.m. and the world’s largest Christmas tree and the largest ferris wheel will shut down at 10:45 p.m.

Chairman Jansen closed the public hearing at 8:05 p.m.

Long indicated if we didn’t approve this project and it remained Industrial and Commercial the worst case could be all Industrial with no re-zoning of private property.

Mr. Crosson added that if any private property was added to the current request, he would have to come back to the Planning Commission to have it included.

Cox questioned how much water would be trucked in? Mr. Crosson replied 8,000,000 gallons. Cox wondered what would go in the residential section. Mr. Crosson replied 450 apartments or 150 homes max.

Hood stated the intent of a Planned Unit Development is to provide flexibility and to encourage imaginative and creative use and design of structures.

She then read into the record Article XIII, Section 13.17 – PUD Application Procedure, process B.

B. Pre Application conference.

2. The applicant shall submit a Preliminary Development Plan with a petition for rezoning to PUD District. The following written and graphic documents shall be submitted:

a. A legal description of the total site proposed for development including the present and proposed ownership of all or parts of the development.

b. A written statement of the nature and character of the proposed development, and the methods to be used in achieving these goals.

c. A written schedule of the approximate date, or dates, if the development is to be divided into stages, when construction will begin and be completed.

d. Quantitative data for the following: total number and type of dwelling and non-residential units, the proposed floor area, ground coverage, outdoor livability and open space ratios, the proposed gross residential density of any separate stages, the number of parking spaces for each use proposed, any feasibility studies the applicant wishes to submit in support of the plan.

e. A graphic plan at scale of 1:1,200 (1 inch=100 feet) showing the existing site conditions, including contours, at an interval no greater than five (5) feet, waterways or bodies of water, unique natural features, rock outcropping and vegetative cover.

f. A preliminary plat meeting the requirements of the Land Division Act, P.A. 591 of 1996, formerly the Subdivision Control Act, P.A. 288 of 1967 if the land is to be platted.

g. A site plan or plans at a scale of 1:1,200 showing the location and floor area and use of existing and proposed buildings, structures, and improvements, including maximum heights, the location and size of all areas to be conveyed, dedicated, or reserved as outdoor livability space, recreation areas, schools sites, and similar public or semipublic uses, the proposed circulation system, including private and public streets, parking and loading areas, pedestrian ways, and access to existing and planned streets outside of the development, the existing and proposed utilities including sanitary and storm systems, and water, gas, electric, telephone, and television cable lines and preliminary landscape plan.

h. A plan at an appropriate scale showing land areas adjacent to the proposed development, their uses, zoning and general character, and the effects of the proposed development on such land including the treatment of the perimeter areas of the PUD.

i. Additional material as may be required by the Planning Commission.

Hood moved, supported by DiPonio approval of the re-zoning request based upon the requirements cited in Section 13.17.

Roll Call: Long, aye; DiPonio, aye; Jansen, aye; Cox, aye; Hood, aye. Motion passed unanimously.

Motion by Cox support by Long to adjourn at 8:20 p.m. Motion passed unanimously.
